Will cover your (the insured's) liability for loss or damage to ships, their
cargoes, wharves, piers, and docks while the ship is being either loaded
or unloaded.
Under a CGL (Casualty Policy) a stevedore can obtain insurance
coverage for most of the exposures encountered. However, a CGL's
care, custody and control exclusion does not give him protection for
damage to the area of the ship or the dock in which he may be working.
Will cover your client's liability for physical loss or damage to vessels,
equipment and their cargoes, freight or other interest while in your (the
insured's) custody at landing or mooring facilities owned or operated by
you (the insured).
Covers marine terminal operators legal liability for loss or damage to cargo
while in your (the insured's) care, custody or control (docks, piers, wharves
or terminals). It may also include stevedores and wharfingers liability for
loss or damage to the property of others arising out of your (the insured's)
performance as terminal operator.
Covers contractors liability for altering or repairing a customers vessel at
their shipyard, at sea, or at other locations. The policy additionally covers
you (the insured) while the customers property is under the care,
custody, and control of your business.
Masters and members of the crew are not restricted to statutory compensation
acts (State Workers Compensation) and may sue their employers for injuries
sustained in the course of employment. This is stipulated under federal law
named "The Jones Act".
A Maritime Employers Liability insurance policy covers employers potential
liability under the Jones Act in excess of a deduction or retention. A $25,000
sub-limit is generally available from your (the insured's) Workers
Compensation Insurance. A Maritime Employers Liability insurance policy is
often attached as excess to this amount.
The Longshore Harbor Worker's Compensation Act or USL&H, provides
compensation to an employee if an injury or death occurs upon navigable
waters of the United States. This includes any adjoining dry dock, wharf,
pier, terminal, marine railway, building-way or other adjoining area usually
used by an employer in loading, repairing, dismantling, unloading, or
building a vessel.
Unlike Florida State Workers Compensation Insurance, which is regulated,
Longshore Harbor Workers Compensation claims fall under the jurisdiction
of the U.S. Department of Labor. Longshore Harbor Workers
Compensation claims can have a higher benefits schedule, more severe
penalties and very serious legal ramifications for non-compliance.
